EBay claims illegal attempt by Amazon to poach top sellers

SEATTLE – eBay claims that Amazon has illegally attempted to attract the best sellers in its market by leveraging its internal messaging system.

The auction site said it was informed of the situation last month by an eBay seller contacted by an Amazon representative. A preliminary survey conducted by eBay revealed that at least 50 representatives of Amazon had sent hundreds of solicitations in recent years. Contacts with Amazon came from several countries, including the United States and Great Britain.

EBay sent Amazon a letter of cessation and discontinuance on October 1, in which she set out her claims. The auction company said that representatives of Amazon seemed to know that their use of the eBay messaging system violated the terms of use of the company.

"Ebay is looking for key terms and they're not exactly like us, we're poking around," reads a message. "Honestly, the easiest way to communicate about it would be over the phone." Other messages involved strange sentences that appeared to be intended to avoid detection, for example by avoiding using the word "Amazon" and writing "amazon Australia" or "AMZN
