A Wisconsin high school will not punish students who did what appeared to be a Nazi salute on a group photo of the junior prom, as this would violate their First Amendment rights.
The photo of about 60 students from Baraboo High School, some raising their arms to greet the Nazis, became viral after being posted on Twitter earlier in November.
Photographer Peter Gust – who took the picture – said the students were making signs, a story contested by a photo student who did not raise his arm.
The Auschwitz Memorial stated that the images showed "the danger of a hateful ideology", and that appeals were launched for students to be punished for doing so.
In a letter to parents, Baraboo's director, Lori Mueller, said the district could not punish students because they were protected by the first amendment.
"We can not know the intentions of the people involved," she wrote Wednesday in the letter obtained by Wisconsin. State newspaper. "In addition, due to student rights to the first amendment, the district is not able to punish students for their actions."
