TAMPA, Fla. – Uber's driver who accused Tampa Bay Buccaneers quarterback Jameis Winston of throwing a shot in her car, which ultimately led to a suspension of three NFL games, brought a lawsuit against Winston.
In the lawsuit filed in the United States District Court for the District of Arizona, the plaintiff, identified as "Kate P.", states that despite Winston's three-game suspension, he "submitted a sexual apology in July and hostile behavior and seems to be no closer to understanding the impact of his conduct. "
The lawsuit, a copy of which was provided to ESPN by plaintiff's attorney John Clune, alleges that Winston, while waiting in March 2016 at the Los Betos restaurant in Scottsdale, Arizona, was "belligerent" and leaning towards [her] and placed her fingers between her legs and pressed them firmly against her vagina over her yoga pants.
She looked at Winston's hand and replied, "What's going on?" before Winston withdraws his hand, the suit says. She then immediately tried to call her boyfriend before sending him a series of text messages. In one of the texts she wrote: "I have just been half molested by the QB Tampa Bay Buc", and that she was "rather upset …"
The woman did not report to the police but discussed it with her boyfriend. She reported the incident to Uber the next day. Uber contacted Winston, who told the carpool service that there were other passengers in the vehicle that night.
An eight-month investigation in the NFL concluded that Winston had engaged in prejudicial conduct that night by "improperly and sexually harming the driver without his consent and that disciplinary action was necessary and appropriate".
She claims damages in excess of $ 75,000 because of the "damage caused by emotional distress and future therapy expenses".
Representatives of Winston said they were anticipating the lawsuit, adding, "With regard to legal representation, Jameis has some advice, he has a good group of professionals around him right now."
The suspension costs Winston $ 124,411 in play checks. He is expected to return from suspension next week.
Winston was also the subject of a sexual assault investigation while he was attending the state of Florida. Winston was never charged, but the student, Erica Kinsman, filed a civil suit against him and he replied. The lawsuits were settled amicably in 2016 and the details were not disclosed.
Florida State was, however, found guilty of treating his claim in a lawsuit brought by Kinsman, who was also represented by Clune. In January 2016, the school agreed to pay him $ 950,000 but did not admit responsibility for the settlement.
