BISMARCK, ND – A federal judge on Thursday dismissed the application of a tribe of North Dakota Indians to block the state's law on voter identification just days before. the elections.
The North Dakota law requires voters to present to the identity card a residential mailing address, which, according to the American Indians, is not always evident in the reserves.
The Spirit Lake Sioux Tribe sued the state on Tuesday for a temporary ban order, claiming that the requirement for municipal address was unconstitutional.
US District Judge Daniel Hovland wrote that the allegations made him "very worrisome", but that he refused the motion because it would create confusion so close to the election.
"Federal courts unanimously believe that it is extremely important to preserve the status quo when elections are fast approaching," Hovland said.
The state maintains that everyone has a mailing address via the 911 system, but the lawsuit filed by the Native American Rights Fund, the Campaign Legal Center and two law firms says the system is "incomplete, inconsistent and subject to reservation errors ".
"We are disappointed with the result," said Matthew Campbell, a lawyer for the Native American Rights Fund. "Voting of qualified voters is imminent."
The Chippewa Turtle Mountain Band filed a lawsuit against the voter identification requirements in 2016. Hovland sided with the tribes in April, agreeing to broaden the evidence of 39 identity to use and ordering the elimination of the requirement to include in these documents the residential addresses. But an appeal board overturned him and the US Supreme Court earlier this month sided with the state.
The four great Native American tribes in North Dakota have been struggling ever since to make sure their members can vote in the elections, which include a race that can help determine control of the US Senate. US Republican Representative Kevin Cramer challenges Democrat Heidi Heitkamp, who narrowly won his seat in 2012 with the help of the American Indian vote.
Hovland had previously estimated that 5,000 Indians in America had not identified an eligible voter. The tribes, who believe the figure is larger, said earlier this week they have distributed more than 2,000 pieces of identity following the Supreme Court ruling.
