Maryland reportedly asked Ellen Hollander of the Federal District Court of Maryland to declare Whitaker's appointment illegal, noting that the President had used the Vacancy Reform Act to fill the vacancy created by the sessions. The state will argue that Trump's invocation of the law was atypical, as it is intended for routine postings and not the highest position of the Department of Justice (DOJ), the Times reported.
Another law expressly states that the Deputy Attorney General must be appointed if the Attorney General leaves the post, says the document.

Some Democrats have expressed concern that Whitaker's appointment is Trump's attempt to undermine the Mueller Inquiry, which he has described as a "witch hunt" for over a year.
Democratic leaders sent Sunday a letter asking the Justice Department's Ethics Office to provide him with an official update asking if Whitaker should recuse himself for not overseeing Mueller's investigation.
