No charges against a man who severely beat a patient in a retirement home

GREAT RAPIDS, Mich. – Kent County District Attorney Chris Becker said he was not going to charge a man accused of severely beating his roommate in a Grand Rapids nursing home.

Dan McBrian, retired machinery operator, died in July from a fractured jaw injury several months after being assaulted by another patient at the Samaritas Senior Living Center.

The Kent County Medical Examiner ruled that the death of July 11 was a homicide, but today, the prosecutor said he was not charged on the grounds that the "death penalty" was a death sentence. assailant was a patient with dementia and could not be held responsible for his actions.

The man suffers from dementia and Alzheimer's disease at an early stage, which according to Becker has caused impaired judgment, insight and impulse control.

"There would be no point in accusing" the 61-year-old man, Becker said in the three-page decision released Wednesday, Oct. 10.

"His mental state would prevent that from happening," wrote Becker. In these circumstances, this office will not file a complaint against him for this incident. "
