Burch was found unconscious and did not breathe at the Kappa Sigma fraternity house in Morgantown. He was from Williamsville, New York, in the suburbs of Buffalo. Police determined that it was an alcohol related death.

The lawsuit was filed by Burch's parents in 2015 in the Monongalia County District Court.

As part of the settlement, the insurer also donated $ 20,000 to the WVU Children's Hospital's critical care services and $ 5,000 to the Children's Recovery and Education Center. organs.
