The Philadelphia woman, whose arrest on a Wildwood beach has become viral this summer, will face charges, a Cape May County grand jury said Monday.
Emily Weinman, 20, of Kensington, was charged Monday morning with aggravated assault, arrest resistance and Memorial Day weekend charges with Wildwood police.
Bystander's videos of the incident showed that a patrolman hit Weinman twice in the face, at the sight of other people on the beach, first provoking outrage at police conduct.
Wildwood police later revealed that the arrest was the result of Weinman's refusal to comply with the officers' request to provide his name. The officers suspected Weinman of drinking alcohol. Weinman passed an alcohol test and explained to the police that the alcohol contained in his cooler belonged to his aunt.
In the video of the camera, one of the police says he will stop her after she refuses to give her name. Weinman walks away and we hear the officer say, "Okay, you'll let yourself down."
She seems to push the agent near where his camera is attached to his uniform. Weinman is then taken to the ground and one of the officers throws punches at his head. Police claimed that Weinman had hit one of the police before they tried to arrest him. They later said that she had spit on one of the policemen.
Both officers involved in the incident were released from any wrongdoing after a review of the department by the incident.
Weinman saw a plea deal in July but decided to reject it.
"A situation does not define anyone," Weinman said during an appearance at "Good Morning America" in June. "I'm not a bad person, I'm not that person they're trying to make me believe."
