A father having dinner with his children at McDonald's in Birmingham, Alabama, fatally shot a masked man who had entered the fast food restaurant and opened fire, reports WIAT, a CBS affiliate.

Birmingham police responded to McDonald's around 10:45 pm Sunday after receiving reports that several people were shot dead. When an employee opened the door to let out a father and his two sons from the restaurant, a masked man came in. The man then started shooting. Investigators say it's unclear whether he intended to rob McDonald's or he was targeting someone inside.

The father then opened fire on the gunman, wounding him fatally. The unidentified father and one of his children, a minor, were also beaten, but did not present life-threatening injuries.

The investigation is still ongoing, but on the basis of preliminary information, the father will face no charges, reports the station.
