The case of Mac Miller's DUI will be dropped by prosecutors after his death

The arrest of Mac Miller for driving under the influence and the subsequent charges he has suffered will be dropped by the prosecutors because of his death.

TMZ reported that the Los Angeles City Attorney's Office will formally file the charges against the late rapper. He was to be charged on Tuesday.

Miller was arrested in May after hitting a sidewalk and colliding with an electric pole. The rapper "Fight the Feeling" and two passengers then fled on foot. He was arrested for DUI at home an hour later.

Two months later, Miller called the arrest a revealing experiment that would help him clean up his act.

"I made a stupid mistake," he told Apple Music's Beats 1 in July. "I am a human being, but it was the best thing that could have happened.

In August, Miller was charged with two impaired driving charges: one for impaired driving and one for driving with a blood alcohol level of .08 or higher.

Miller, whose real name is Malcolm James McCormick, died Friday from an apparent overdose at the age of 26. An autopsy is complete but the cause of death will not be announced until the toxicology tests are completed.
