Winnipeg's first ticket for the self-assessment of a legalized car after one hour

An hour after the pot was legalized, the Winnipeg police issued their first ticket for cannabis use by car.

At approximately 1:00 am, Winnipeg Police Service Traffic Division, Insp. Gord Spado says one of his officers issued the ticket during a roadside check.

"An hour of legality and something illegal," Spado said Wednesday.

It is not clear if the labeled person was driving or not at the time.

Spado stated that although the cannabis was probably illegally purchased (online sales started at 12:01 but have not yet been delivered at 13:00) – no tickets were issued for this.

"It does not appear that anything has been pursued regarding its illegal component," he said. "I think it's only the education part of our members, knowing where to go with that – it's still new to us too, so we continue to learn."

Spado notes that it will be difficult to determine if cannabis was illegally purchased. Another challenge will be to force people to consume food products in vehicles.

"If someone has an edible in a car and we can prove it, it's also a crime," Spado noted. "Sometimes we can [prove it]sometimes we can not. And when the edible products are legally produced commercially, it might be a little easier, because there will be packaging and things like that might be visible.

The ticket, like many offenses relating to legal marijuana, comes with a $ 672 fine.

Since the Cannabis Damage Prevention Act was amended last year, WPS agents have published two citations for the transportation of cannabis in a vehicle.

Some fines for new marijuana offenses:

  • $ 2,542: Supply of cannabis to a young person under 19 years of age.
  • $ 2,542: Grow non-medical cannabis in a Manitoba residence.
  • $ 672: Smoking or spraying cannabis in provincial parks.
  • $ 672: Smoking or spraying cannabis in a public place.
  • $ 237: Driver carrying cannabis in or on the vehicle (not in the trunk, even fine for off-road vehicles).
  • $ 672: Use cannabis in or on a vehicle on a highway.
  • $ 672: Use cannabis in or on an off-road vehicle.
