Government issued a standard to establish conditions for Venezuelans' fixed work

The Ministry of Labor (MTPE) today issued a resolution that establishes provisions for Venezuelan nationals with temporary permits to have permanent employment.

Stability of Work

The Ministerial Resolution, published in the Official Journal El Peruano stresses that the hiring of Venezuelans is provided they have Temporary Permission (PTP) or Extraordinary Work Permit Act – provisional .

Said contract as well as its extensions and amendments are written and fixed-term, and must not exceed the validity of the law on the temporary-temporary work permit or the PTP.

"The period of time fixed by the parties can not be longer than the validity of the extraordinary work permit – Temporary Permit Permit or Temporary Permit – PTP", states the standard.

Conditions Required

The standard specifies that for the signature of Venezuelan's employment contract, its extension or its modification, must the law on the permit of extraordinary-temporary works or PTP be in force.

Both the employer and the worker may agree that the employment contract will be automatically extended in accordance with the extension of the permits, for an equal or shorter duration.

The loss of validity of permits The work, as well as the non-granting of this permit, constitutes a resolutory condition which automatically extinguishes the employment contract .

The resolution signed by the Minister of Labor, Christian Sánchez also indicates that during the validity of the contract of employment is obtained a migratory quality different from the PTP which supposes the subjection from the working relationship to the provisions corresponding to the new migratory quality
