A Republican member of the West Virginia House of Delegates has been accused of being part of a crowd of supporters of President Donald Trump who stormed the U.S. Capitol earlier this week, the Justice Department said on Friday.

Delegate Derrick Evans had filmed himself and others heading to Capitol Hill on Wednesday. “We’re here! Keep moving, baby!” Evans said in a video posted to social media.

Evans was charged with illegally entering the Capitol.

Evans’ lawyer said on Thursday that Evans “did not commit any criminal act that day” and that he would not resign from his post.

The riot broke out shortly after a crowd of Trump supporters arrived on Capitol Hill following a rally. At the rally, the president encouraged attendees to fight with him in his effort to prevent Joe Biden from being confirmed as the next president of the United States.

Congress suspended its confirmation of the Electoral College’s vote count on Wednesday afternoon after crowds of people invaded the Capitol. But in a joint session of Congress early Thursday morning, Biden’s election was confirmed.
