Rubio on Tuesday introduced the Treatment Restoration Act for Emergency Antibody Therapy (TREAT) in response to a change from the Biden administration that requires states to go through the Department of Health and Human Services (HHS ) to receive treatments and caps the number of treatments. every state can receive.

Previously, medical providers could order antibody treatments directly from the provider.

If passed, the Rubio Bill would prevent the HHS from putting in place policies preventing healthcare providers and hospitals from purchasing monoclonal antibody treatments from distributors and manufacturers.

“This brutal policy change by the Biden administration is nothing more than an attempt to punish Florida,” Rubio told Fox News in an emailed statement. “We cannot allow the vindictive and politically motivated actions of this administration to endanger the health and safety of Floridians and others.”

“My bill would restore fairness by allowing hospitals and other appropriate health facilities direct access to this life-saving treatment from the manufacturers,” the Florida senator continued.

Joining Rubio on Bill as co-sponsors are fellow Republican Sens. Marsha Blackburn from Tennessee, Rick Scott from Florida, Kevin Cramer from North Dakota and Roger Marshall from Kansas.

Florida is one of seven states, along with Texas and Alabama, which account for the majority of treatment demand. White House press secretary Jen Psaki said last week that the seven states accounted for around 70% of requests.

Some reports have alleged that the new HHS policy is political punishment against the Red States for failing to support the mask and vaccine mandates.

HHS did not immediately comment on Rubio’s bill.
