WALTON, Ky. (AP) – The lawyer of a Kentucky high school student who was not allowed to participate in school activities because he was not vaccinated against chicken pox said his client had now contracted the disease.

Lawyer Christopher Wiest of Covington told Kentucky Enquirer that Jerome Kunkel, 18, contracted chickenpox last week. Wiest says that Kunkel goes "well" and "stung a little".

After an epidemic, unvaccinated students were instructed to stay away from school and church activities in Notre-Dame-de-l'Assomption.

Kunkel sued the northern Kentucky health department, saying the vaccine went against his religious beliefs, and others joined him. Last month, a judge denied the request for resumption of activities.

Wiest said Tuesday that nearly half of its clients had contracted chickenpox since the file was filed. He said he told the parents that this would be the fastest way to solve the case.
