Vienna. The questionnaire of the Minister of Justice, Josef Moser (ÖVP) in the inquiry commission of the BVT proved to be unproductive. On many issues, he mentioned the competence of the prosecutor not to submit important files to the panel, denied the head of department. Moser reiterated that he saw the need to change the delicate breaks.
Specifically, he considered it "appropriate" for the Attorney General's office to be involved in investigations of institutions of particular interest. In this case, it did not happen because the law does not provide for it. Journalists should in the future be informed in writing of the idea of Moser, which did not materialize in the BVT case, even before the house search was approved. But an agreement should only be possible if life is in danger.
Much to the chagrin of the Secretary General of the Ministry of Justice, Christian Pilnacek, who had not been informed before by his counterpart of the Department of the Interior, Peter Goldgruber, Moser is rather distant. When asked, he said that there was no formal (predefined) route as it involved two different departments. It was just a habit here.
Moser shares the pressure of the investigation
As a result of investigative pressure in the case, Moser extinguished. Otherwise, there would probably have been no request for a home search late at night. Above all, the closest badociate of the Secretary General of the Ministry of the Interior, Peter Goldgruber, Udo Lett, should also have pressed for the suspension to be pronounced.
The street crime task force conducted a house search, which was subsequently overthrown by the courts, and Moser is not under his responsibility. It's the prosecutor's decision, because the minister has no control. He did not know that the leader of the EGS was a member of the FPÖ.
At the end of the summer, Moser ordered a separate group from the Korneuburg prosecutor's office to re-examine what was happening during the home search of the BVT. There are no results yet. The investigation would have been very thorough, informed the minister, who also recalled the various commercials of the case, with some accused, other suspects and others only. The persons concerned are all involved in the case of the competent prosecutor, Ursula Schmudermayer, responsible for the Minister of the Interior, Herbert Kickl (FPÖ), the director of the BTS, Peter Gridling, before the Secretary General, Goldgruber.
Defended action
Overall, the minister defended the actions of the prosecutor. These had to lead with a proper suspicion investigation. In many ways, the corruption prosecutor's action has also been confirmed, in others, like the raid no: "The procedure shows that the judicial system works."
