The Attorney General's office in Vienna accuses ex-judoka Peter Seisenbacher of abusing minors between 1997 and 2004. For the 58-year-old, the presumption of innocence applies , a process could not take place until today because it escapes the Austrian justice in Ukraine.
As is now known, the Migration Department of Kiev has already rejected an asylum application for the double Olympic champion in 1984 and in 1988 on 2 November 2017. On the other hand, the native Viennese filed an appeal, which was rejected on 20 November by an administrative court in Kiev.
This decision was published Thursday in the register of Ukrainian courts and is not yet final. Seisenbacher can now appeal within 30 days.
Seisenbacher's application was manifestly unfounded, as there was no reason to fear that he could be prosecuted for ethnic, religious, social or political reasons, the competent authority said.
The ex-athlete sees things differently. "The Austrian authorities are not able to protect Seisenbacher from human rights violations because they themselves are the agents of its illegal prosecution," the verdict said in a statement quoted by Seisenbacher. "I fled because I could not wait for a fair trial," he said.
What is happening with Seisenbacher in Ukraine is not yet clear. The offenses of which he is accused are already prescribed in Ukraine. Since 2017, the Austrian judiciary has tried in vain to extradite ex-judokas.
