The owner had sued the court against the amount of compensation set by the republic. The latter then decided that the expropriation allowance for the entire property in Braunau, "especially considering the fact that the main building is the birthplace of Adolf Hitler" , was to be set at 1.508 million euros.

The VfGH had previously stated that the expropriation itself, which had been preceded by a one year discussion between the owner and the Ministry of the Interior, was legal. The trial before the European Court of Human Rights is still ongoing.
