A 47-year-old auto mechanic was sentenced on Wednesday in Klagenfurt Regional Court for abuse of power at five months of detention. He had lit in the car, obvious parts such as the brake discs or the exhaust had been replaced, the underbody had been re-injected. "Everything was dark enough, it would have meant that everything is repaired."
He did not realize that the damage was partially covered. He did not perform a knock test or scraped the underbody parts to see if the damage caused by the rust had actually been repaired. The mechanic confessed this to the jury and Judge Ute Lambauer. However, he should have performed these tests in order to control the actual correction of the defects of the first examination, said an expert. "He was naturally misled." A visual inspection is simply not sufficient in such a case. "Was it an accommodation?" Asked the judge. This denied the accused. He did not know the owner of the car at the time.
This sold the aesthetically polished Suzuki for 2,500 euros. The value would have been the vehicle probably only 350 euros, said the expert. Since the accused had paid compensation to the buyer of a car, he was blameless and confessed to having obtained an extraordinary mitigation measure.
