A 44-year-old Viennese, struggling with an obvious aggression problem, was Thursday occupied by a Schoten Senate at the regional court.

After excessive violence against a long-time friend, a 44-year-old Viennese was sentenced Thursday by the regional court to seven years in prison. The verdict of guilt for intentionally serious bodily harm, deprivation of liberty and dangerous threat is not final. The man filed an appeal on nullity and appeal.
On February 14, 2018, the defendant had received a friend in his Brigittenau apartment, which he had known for over 30 years. People started drinking and arguing – allegedly jealousy about the 44-year-old girlfriend. Suddenly, he beat him on the ground, sat on him and slammed his fists in the face, reported the 53-year-old witness. Then the attacker took a kitchen knife, attacked him and cut his forearm. Seriously injured, he spent the night on the floor of the living room – the defendant had locked the room. He could not leave the apartment until the next morning.
Treatment instead of punishment
"I would like him not to be punished, but a treatment, as soon as he drinks a drop of alcohol, he becomes unpredictable, I want him to go away, he has a real psychosis, "said the witness. He specifically pointed out that he continued to be friends with the defendant who, in addition to numerous cuts, had inflicted several fractures to the bones of the nose.
The defendant had previously baderted that the witness's account was a "pure invention". He had not come across this in the period in question: "Since I was not in this medium." After all, he admitted, "It can happen that I am aggressive."
This is demonstrated by the criminal record of the man, which was discussed early in the trial. "18 criminal records, of which 12 are relevant," said Judge Olivia-Nino Frigo. "Hm," said the accused. " Why? The judge asked. "Addicted to drugs," replied the accused. Since 1989, he has taken everything "through the bank". Aggressive do so in relation to alcohol, which he was not opposed to, but not necessarily: "I usually sleep on it".
Bus ride on board drugs
However, this did not coincide with what the pbadengers experienced on 30 September 2017: a bus trip from Vienna to Kleinhaugsdorf (Hollabrunn district) led to a visit to a reputed shopping center. The 44-year-old, who was on the bus under the influence of psychoactive substances with his partner and their son, was already the victim of misunderstandings on the outward journey, other pbadengers and the bus driver. On the way back, the tour group was afraid of the enraged Mittvierzieger. A child started crying while he fumbled, depositing food on the curtain next to his seat and drumming against other seats.
"I was upset because the toilets were dirty," the defendant said when the judge confronted him with this charge. And further: "I like to talk silly, if I take something."
When an elderly woman asked him to shut up at last, according to the accusation, he wanted to take her fists. A young man intervened and prevented rough things. Another pbadenger finally called the police and photographed the troublemaker with his smartphone, where he suffered insults and death threats.
