In this month’s federal court recess tally, Ballotpedia tracked Article III court appointments, confirmations and vacancies from September through October 1. Ballotpedia publishes the federal judicial vacation count at the beginning of each month.

STRONG POINTS

  1. Vacant jobs : There have been four new vacancies since the August 2021 Report. There are 81 vacancies out of 870 active Article III judicial positions on the courts covered in this report. Including the United States Federal Claims Court and the United States Territorial Courts86 of the 890 active federal judicial positions are vacant.
  2. Applications: There have been 18 new appointments since the August 2021 report.
  3. Confirmation: There have been five confirmations since the August 2021 report.

Four judges have left active status, creating a lifelong Article III judicial vacation since the previous vacation count. As Article III judicial posts, vacancies must be filled by appointment of the President. Applications are subject to confirmation on the advice and consent of US Senate.

  1. Judge beverly martin retired from United States Court of Appeals for the 11th Circuit.
  2. Judge Richard Brooke Jackson assumed higher status on the United States District Court for the District of Colorado.
  3. Judge Rosanna Peterson assumed higher status on the United States District Court for the Eastern District of Washington.
  4. Judge Jeffrey Viken assumed higher status on the United States District Court for the District of South Dakota.

As of October 1, the Senate has confirmed 14 of Biden’s judicial candidates – nine district court judges and five appeals court judges – since January 2021.
