We are used to the fact that Belarusian IT companies are reliable, prestigious and "white". It was all the more surprising to hear the victims tell the story of IT Shark LLC: people did not get paid and even the winning courts did not move things. In addition, several years ago, private state-owned media (for example), of which we were informed, spoke about the director of the company. Next, Alexander Dubovitsky was a 17-year-old robotics specialist. Four years later, many of his employees fought the young man, who, for proof of his accuracy, brought with them a huge pile of documents and won his case.
Pulled under the article, but the court took over
"IT Shark", as say of former employees, was engaged in outsourcing. What projects exactly – can not say because they signed a confidentiality agreement. People observe it, even if, in general, companies do not owe anything: on the contrary, they owe it to them.
Andrei (the name was changed at the request of the hero) was invited to "IT Shark" as a business consultant last July. In fact, he had to engage in recruiting: selecting new employees, mostly programmers.

It is time to pay, and it turned out that the director, Alexander Dubovitsky, was delaying payment under various pretexts. There is suspicion that something is happening. In addition, I have a responsibility to the people I have hired. He started sorting out: they did not pay, nor did the employees who worked for about two months. The management was constantly avoiding the questions. Finally, they decided to fire me for an article. [п. 6 ст. 47 ТК РБ «в связи с разглашением коммерческой тайны». — Прим. Onliner]. Then I was reinstated at work by the court. I was restored, but I did not work there anymore. From there, everyone stopped smoking and "IT Shark" still has debts to everyone we keep in touch with – about 15 people.
There was nothing to recover
In total, according to Andrew's calculations, the company owes its employees between 10,000 and 15,000 rubles: it is difficult to say the exact amount; The amount is too small for a computer company of about 20 people, but there is a reason for this: Andrew says he registered people for part time rates and that the promised salary had to be matched with various bonuses. The caveat is that in a lawsuit, an employee can claim only the amount that has been specified – no bonuses are taken into account.
Former employees said that people did not stay at IT Co. Shark for more than a month or two: as soon as they realized there would be no salary, they left and recruited them again. The company has managed to work for about a year, but there are few negative reviews on the forums. Nevertheless, some workers have decided to make a living. They won the courts, there are briefs. But there is nothing to recover from the LLC: the accounts are empty.
– Since the bailiff started trying to get something out of IT Shark, three months have pbaded. The company's management then opened a new legal entity and continued working under the old scheme. And what to do now with "IT Shark"? There is no money, which is the founder is not clear. At first, Dubovitsky said that he was the founder. The result was that he was a committed director. We discovered that there are two founders: a Belarussian citizen and a Russian. Then it turned out that the founder is one – the same Russian. His contacts are not.
What will we do? The bailiff says that, as the legal entity does not work and nothing can be done, it will be declared bankrupt and we will issue a corresponding document. With this document, you can contact the authorities so that the debts are recovered not from a legal person, but from a natural person, the owner of the company.
He will receive a ban on leaving the country, arresting property, etc. This is now the only legally correct way to recover money.
At the beginning of the trial, Dubovitsky resigned from IT Shark and brought Belinsky, Ipresnik's lawyer (to the position of general manager), in his place. And he had already started going to meetings, was a representative of the LLC. Further Belinsky left the company. In fact, there is no one, no one to communicate with. In my opinion, Article 209 of the Penal Code is a fraud. Why A group of people understood how to exploit employees without paying them money.
Authorized fund of 50 rubles
The new company, as the workers concerned say, is called "Generalov Development". Its statutory fund, according to the resource kartoteka.by, is 50 Belarusian rubles (the same amount is indicated on IT Shark). The company's website was not found, but on the recruitment sites, it is stated that it is part of the Generalov group of companies.
The linkedin.com service is clearly described: "The Generalov Group is a group of companies active in the fields of software, hardware, manufacturing and computer science since 1988". It is stated that the company operates in the areas of "production", "robotics", "software development" and "computer and hardware courses". The society is young: if, in the first sentence, it is reported that the group Generalov is active since 1988, the year 2011 deserves for some reason a year of foundation. Task: to do good
The story of Elena (name changed) is similar. The girl works as a user interface designer and is seen to offer a parallel job. The conditions, she said, were discussed with Belinsky. The office of "IT Shark" Elena was not impressed: "A huge room without heating, the developers are heated at the tables with tea. They say that they have just moved in and are not yet settled. It seems that we have just decided to create an entourage – the layout of the tables is totally illogical. Dubovitsky, in another room already hot, scratched a kind of purebred cat. I've also thought: "A strange attitude towards my employees: they freeze and you're warm".
– I tried to talk to Dubovitsky and clarify the task of the project, but it was expressed with general phrases of the type "it must be done beautifully". They said that I only have four days: they say that the project was abandoned by the designer, you have to finish everything urgently, – remember the girl. – Well, such stories happen sometimes, I was not surprised. I managed to do everything in time. Moreover, if I understood correctly, a commercial badyst appeared. He said that everything was wrong – the customer would not have been convinced that we had changed the design into a new one. Wait a second, so where is the old design? It turned out that there was a user interface kit – something that looks like a set of items of the same style. For some reason, they tried to call it a brand book, although it's a whole other thing. It became clear that people did not really understand what they were talking about. That put me on my guard, but the customer does not have to be a professional. He simply says, "I need that, but I do not know how to do it." Initially, I was called to make a request, which then turned into a website. Ok, reworked.
The payment should have been made one month after the signing of the document on the work done. Money that Elena saw:
– They said that there were difficulties. What kind of thing is incomprehensible. There were rumors, they did not say anything. According to one version, the problems were related to my card – so-called hard work with this bank. Although I own several cards from different banks and you can transfer money to any of them. Then another employee said that he had been informed of the difficulties encountered in transferring money to another bank, not the one I had.
Other IT group employees also turned to Onliner editors: their stories are usually echoed by those of Helen and Andrew. In this case, some people were a bit luckier: a few people worked for about six months and first paid the money. In addition, the victims admit that the founder of the company (the same Russian) may not be aware of the real situation, but it is impossible to confirm – there is no contact.
It was not possible to contact Alexander Dubovitsky, the former director of "IT Shark" LLC: he did not respond to the request on LinkedIn, the phone numbers that were provided to us are disabled. But we spoke with Pavel Belinsky:
– At first you were the deputy director of IT Shark and Dubovitsky, the director, is not it?
– That was.
– So in court, you were the accused?
– Not me, but the company.
– Then, the company has somehow stopped its activities?
– That's true.
– Now, former employees say that they have not been paid. Is it true?
– To do this, contact the competent authorities, they have all received answers.
– There were answers and people won the courts, but they did not receive the money: the company's accounts are empty.
– I do not know what to say to that, for the simple reason that I have not disposed of money. The cash declaration was not my responsibility.
– Are you in some way related to the "group of generals" or the "development of generals"?
Absolutely nothing.
