The lawsuit was filed after McDonald's attempted to prevent Supermac's expanding network in the EU. The American company explained this by the fact that consumers would confuse the name Supermac and the McDonald's Big Mac burger. Representatives of the Irish company said that their competitors register brand names to be used in the future compared to other companies.

The EUIPO based its decision on the lack of evidence of the actual use of the Big Mac brand. According to the publication, the agency felt that using Big Mac on behalf of the hamburger was not enough.

The US company has announced its intention to appeal the decision of the EUIPO and again hold full trademark rights throughout Europe.
