The criminal court of Tournai acquitted Thursday a woman who was prosecuted for manslaughter, for lack of foresight or precaution, on a newborn. On May 10, 2014, the mother had given birth to a granddaughter, found dead in the bathroom. The mental health experts indicated that she had a denial of pregnancy and, as a result, she did not behave carelessly.

For the court, the causal link between his behavior and the brain injury, the cause of the child's death, is not established. The cause of this trauma has not been sufficiently established either. This lady had claimed that she did not know she was pregnant. Very strong at the time, she was no longer regulated but, according to her defense, amenorrhea was frequent at home. Although she was suffering from more and more frequent stomachaches, she refused to go to the doctor, traumatized by a recent operation of the wisdom teeth. The night of the facts, she stayed more than five hours in the toilet. When help arrived, the child died in the toilet bowl.

"In its judgment, the court considers that there is no causal link between the behavior of the mother and the death of the child, who died of a traumatic brain injury. The experts could not determine the cause of the injury. In a second reasoning, the court finds that my client did not behave carelessly because there was a denial of pregnancy on her part.", explained his lawyer.
