Britney Spears’ attorney called allegations her father was sneaking her and monitoring her communications “unfathomable” in a new court case on Monday, establishing it as further evidence to remove it from his case.
The New York Times documentary “Controlling Britney”, which FX and Hulu debuted on Friday, revealed troubling allegations that James “Jamie” Spears had recording devices planted in his daughter’s house. A former aide at Black Box, a security firm employed by the Guardianship, alleged that Jamie Spears asked to monitor all of Britney Spears’ communications, including those with Samuel Ingham, her former lawyer.
Jamie Spears “crossed unfathomable lines,” Britney Spears attorney Mathew Rosengart said.
“The unauthorized recording or monitoring of Britney’s private communications – particularly attorney-client communications, which are a sacrosanct part of the legal system – represents an impermissible and disgraceful violation of her privacy rights and an example striking deprivation of his civil liberties, “Rosengart said in a statement Monday.
Vivian Thoreen, lawyer for Jamie Spears, said her client had “dedicated her life” to helping her daughter change her life.
“Jamie does not answer in the court of public opinion; it comes under a court, the probate court, ”Thoreen said in a statement after the Times documentary was released. “All of his actions were well within the parameters of the authority vested in him by the court. His actions were made with the knowledge and consent of Britney, her duty counsel and / or the court.
Edan Yemini, CEO of Black Box Security, did not respond to detailed questions about the allegations, according to the Times.
The Times documentary follows “Framing Britney Spears,” which debuted in February and helped put the #FreeBritney movement in the spotlight.
Rosengart cited the allegations in a file filed in court on Monday which asserted them as further evidence that Jamie Spears should be removed from his duties as his daughter’s curator. The petition to replace him with a professional accountant was filed in July and will be considered by a judge on Wednesday.
He argued in court that the allegations did not need to be proven to dismiss Jamie Spears, only that the allegations themselves served his client’s best interests. Rosengart called Jamie Spears’ recent documents a “subterfuge, designed to avoid the stigma of being suspended and its consequences.”
“Because of these deeply troubling allegations, Mr. Spears will inevitably focus over the next few days and weeks on defending his own interests and not those of his daughter (again),” the file says. “And whatever the outcome of the allegations, what cannot be truly disputed is how deeply upsetting they are to Ms. Spears and, at the very least, they magnify the need to suspend Mr. Spears immediately.”
Earlier this month, Jamie Spears filed a motion to end his daughter’s guardianship entirely, which is also set to be considered by the judge this week. The move came as a shock to many, as Jamie Spears continued to defend his role as a curator and called his daughter “mentally ill” in a court case a few weeks earlier.
The termination petition asked the court to end legal guardianship without further psychological assessment, which Britney Spears requested in her June 23 testimony.
“The Guardianship has helped Ms. Spears get through a major life crisis, rehabilitate and advance her career, and get her finances and affairs in order. But recently things have changed,” says the folder. “Ms Spears is now openly frustrated with the level of control imposed by a Trusteeship, and has begged this Court to ‘allow her to take charge of her life’.”
