On March 31, Hamilton police were investigating a break-in at a property in Flamborough. A van was stolen. The Hamilton police followed up to Cambridge and notified the Waterloo Regional Police Service, who responded.
"One of the officers located the man and one interaction occurred," said the UES. "The officer unloaded his firearm at the man several times.The man was hit once and transported to the hospital for treatment."
The shooting occurred late in the afternoon at the edge of Highway 401 near Dickie Settlement Road in Cambridge. The man who was shot is 30 years old. It has not been identified by the UES. He was flown to the hospital.
The Record had previously reconstructed a criminal drama with the help of police and SIU statements, and from recorded police communications.
"Show me your hands!" a Cree officer. "Do not move, put your hands in the air now!"
A few seconds later, a policeman kills a suspect after pursuing him through the scrub next to the 401 freeway.
"Gunshots! He's down! Show me your f-king hands! Now!" a Cree officer.
The officer continues: "Shots have been fired.A man is shot down … get me an ambulance please … he was shot in the leg."
Before the shooting, the van left the road to go to a field. A man ran from the van to the bush, carrying a bag.
The police examined the empty van and found two rifles inside. They also found cases of open ammunition with a missing round.
Officers who ran after the suspect caught up with him four minutes later. They confronted him and he was shot.
Police learned the name of the man through a bank card found on him. A Hamilton man of the same name and age was twice arrested by the Niagara Police in 2015, accused of fleeing police, theft, mischief, break and enter, possession of stolen property and drug related offenses.
Although it is the first charge of attempted murder by the UES for a shooting in service, the Toronto Police Const. James Forcillo was convicted of attempted murder on the death of Sammy Yatim in 2013. The death of this 18-year-old man on a Toronto streetcar sparked strong protests against the use of force by the police.
In the weeks following Yatim's death, the UES charged Forcillo with second degree murder. Then, before the trial began, prosecutors – and not the UES – laid a second charge of attempted murder in death. The charge was linked to a second volley of shots fired by Forcillo, while Yatim was lying on the ground, already mortally wounded by the first round.
The charge of attempted murder was the only one found after a jury acquitted Forcillo of the second degree murder of the first three shots.
For years, Dorling has been a rising star in the Homicide Division of the Waterloo Regional Police Service and has led the creation of a new unit dedicated to resolving cases of long-term missing persons.
In 2008, he reopened a handful of suspected cases, work that led him to carry more than 20 undeclared cases of missing persons under the authority of the Homicide Branch. Dorling began re-investigating old leads and launched a public awareness campaign in the hope that this advertisement would provide answers to unresolved cases.
He was then removed from the cold affairs unit and handed over to the active patrol.
Last year, he was quoted in the record by a little known case – the rescue of ducklings who found themselves on the promenade of Conestoga.
"I caught two of them and put them in the pocket of my cargo pants while I ran after another pants that did not want to get caught," he said. "I was in pursuit of the foot to catch a duck."
Dorling is scheduled to appear in Kitchener Court on December 19th.
The Waterloo Regional Police announced Wednesday that its professional standards division will review the circumstances of the shooting "after the end of the legal proceedings".
