“Real Housewives” star Erika Jayne’s husband Tom Girardi suffers from memory loss amid his lawsuits and divorce, his brother said.
Robert Girardi filed a petition in court on January 13 asking for him to be appointed guardian of his brother.
Tom Girardi, 81, is a prominent Los Angeles lawyer and was recently sued, as was Jayne, 49, alleging embezzlement of millions of dollars from the families of plane crash victims.
Robert Girardi has claimed his brother is no longer able to make “rational decisions” on his own in documents obtained by Fox News that were filed in an involuntary bankruptcy case brought by creditors.
“While sometimes the debtor seems to be aware of the filing of involuntary petitions, he needs to be reminded often,” wrote Robert Girardi. “The debtor is unable to realize and understand the repercussions of the bankruptcy filings pending against him and his law firm Girardi Keese.”

Robert Girardi also states that his brother is “incompetent and incapable of acting for himself”.
An attorney for Tom Girardi did not respond to Fox News’ request for comment. A call to Robert Girardi also went unanswered on Saturday morning.
Jayne, who is also a singer and Broadway artist, announced her divorce in November.

“After careful consideration, I decided to end my marriage to Tom Girardi,” she confirmed to Fox News at the time.
The couple have been married for 21 years. In her divorce petition, Jayne asked her husband to cover his legal fees and provide him with alimony. Girardi is said to have asked the court to dismiss the reality TV star’s claim.
