A federal appeals court on Friday dismissed a Trump campaign lawsuit over Pennsylvania’s voting procedures, paving the way for the issue to escalate to the Supreme Court.

Although Trump’s lawyer Rudy Giuliani argued in a lower court that widespread electoral fraud had taken place in a state where President-elect Joe Biden won more than 80,000 votes, the 3rd Court of Appeals of the US circuit said “the campaign’s claims were baseless.”
The Trump campaign has the option of asking the U.S. Supreme Court for an emergency injunction, which would go to Judge Samuel Alito, who would then likely ask his eight colleagues to intervene.
“The activist justice system in Pennsylvania continues to cover up allegations of massive fraud. We are very grateful for the opportunity to present evidence and facts to the PA State Legislature. TO SCOTUS!” campaign adviser, said in a statement on Twitter after the court ruling.
Friday’s ruling upheld US District Judge Matthew Brann’s take on the Trump campaign’s error-filled complaint, which Brann said “like Frankenstein’s monster, was sewn up at random.”
The three judges on the panel were all appointed by Republican presidents.
“Free and fair elections are the cornerstone of our democracy. The accusations of unfairness are serious. But calling an election unfair doesn’t make it that way. Charges require specific allegations, then evidence. We have neither here, ”wrote Judge Stephanos Bibas, a former law professor in his ruling.

The move is the latest blow to Trump’s efforts to prove that election results in several battlefield states where he lost have been “rigged.”
Giuliani held a public hearing alongside Trump on Wednesday and alleged Republicans were denied an opportunity to observe the prospecting process, with Trump claiming they had “hundreds and hundreds of affidavits” of personal stories witnesses to support their argument.
However, the so-called evidence was not presented in many hearings, with judges repeatedly speaking out against the Trump campaign.
In addition to Pennsylvania, Giuliani claimed that similar programs have also taken place in Michigan, Wisconsin, Nevada, Arizona and Georgia.
