Get Covid-19 Vaccine Or Face Jail, Judges Order In Probation Cases

In Ohio, like the rest of the country, private companies can make their own demands on employees and customers. Federal government employees must be vaccinated or undergo regular testing, but state and local government institutions set their own rules. In Ohio, more than 800 school districts and other local entities operate independently, Dan Tierney, spokesperson for Governor Mike DeWine said Monday.

Mr DeWine said Ohio was a state that exemplified the double risk of infection. “Those who are vaccinated are safe, those who are not vaccinated are not safe,” he said.

When asked about his ruling, Judge Frye said in an email Monday that he has issued vaccine prescriptions three times so far, and none of the defendants have raised any medical or religious objections.

“Ohio law allows judges to impose reasonable probation terms designed to rehabilitate the accused and protect the community,” Justice Frye said. He said that, based on medical evidence, the vaccination would protect others and keep people on probation safe when seeking or keeping employment.

Sharona Hoffman, professor and co-director of the Law-Medicine Center at Case Western Reserve University Law School, said it was unusual to pair the sentence with the vaccine.

“Judges are creative in keeping people out of jail,” she said. “They impose all kinds of penalties and, again, it’s for the benefit of the individual. And if you’re going to be in the community, you can’t run around infecting people with Covid. “

In some states, like Georgia, judges have proposed reduced sentences if defendants get vaccinated, WSB-TV reports in Atlanta. Earlier this year, prisoners in Massachusetts were offered the option of reducing their prison terms for receiving the vaccine, but the decision was later overturned.
