At the plenary meetings of the Presidents of the Greek Bars with the leaders of the political parties of the Constitutional Arc, a delegation of the Coordination Committee, led by its President, Dimitris Vervesos, met today with the Opposition opposition leader and the president of New Democracy, Kyriakos Mitsotakis, on the big issues concerning justice and the bar.
In particular, the representatives of the Bars raised the following questions:
• The question of the prolonged detention of Greek soldiers in Turkey, without charge, for more than 4 months in violation of international law.
• The necessary safeguarding of the independence of the judiciary, of all kinds of interventions, in full respect of the constitutional principle of the separation of powers and the prohibition of the public service by the judges for a certain time after their departure.
• The confiscatory nature of insurance and the tax burden on lawyers – freelancers.
• The unconditional application of the decision of the Council of Europe which, according to press reports, declares unconstitutional the affiliation of lawyers to the EMFF and disproportionate to the insurance and the contribution of Law 4387/2016,
Exempt VAT services from VAT, otherwise, by subjecting them to the lowest VAT rate under the option offered by the new draft European Directive on VAT and extending the optional exemption threshold of VAT from € 10,000 to € 25,000
• Legislation on the possibility of secession of ETEAP and the creation of a professional auxiliary insurance fund (second pillar), with the abolition of the corresponding contributions of Law 4387/2016.
• Their opposition to the tribulation of the Athens court of first instance, according to the announcements of the Minister of Justice.
• Guarantee unhindered access of citizens to justice and a legislative initiative, non-existent, to reform the institution of mediation, in accordance with the decision of the Administrative Court of the Supreme Court, declared unconstitutional and contrary to the European law on compulsory mediation as provided by Law 4512/2018.
• Restoring failures in the legal aid program
