What is the sum of sums recovered per year and what categories of retirees can claim?
In retrospect, according to calculations ranging from 800 to 6,500 euros per year, retirees can claim, the cuts made by the 2012 law being unconstitutional three years later, in 2015, by the State Council.
The crucial question is how long applications can be made and how many years the annual difference in the retrospective will be calculated. Indeed, there is a gap between the 2015 CMS decision and the 2016 Catrushula law, which attempts to recalculate pensions in order to comply with the CoE pilot decision.
Since Law 4387 was pbaded in May 2016 but the new calculation is fully operational in January 2019, it remains to be determined whether there is a "void" and to what extent, in order to determine the amount of any claim retroactive.
Some lawyers question the government's badertion that the Catastrougal law was consistent with the Sete decision. So there is no question of hindsight after the law. Therefore, according to this reasoning, only applications related to space before 2015 will succeed. Instead, they say that lawyers may be required for other years.
