The lawsuit against the Henry Ford Health System after their vaccination mandate, which required all employees to be vaccinated, has been dropped.
In late June, the southeastern Michigan health care provider became the first Michigan hospital to announce it required COVID-19 vaccinations for all of its employees. Workers had until September 10 to be fully immunized, otherwise they would be banned from returning to work.
More than 50 employees filed a federal complaint in early September seeking a temporary injunction from the health care provider, claiming the warrant was unconstitutional and infringed their right to refuse medical treatment.
The health group allowed employees with medical and religious exemptions to avoid the warrant.
The case, however, was dropped a day after the president Joe biden announced a new federal vaccine mandate that affects 100 million Americans.
On Thursday, Biden announced an emergency order through the US Department of Labor’s Occupational Health and Safety Administration (OSHA) that requires all employers over 100 workers to be fully immunized their staff or to be tested weekly for the virus.
For federal employees, contractors who do business with the government, and people employed by establishments that accept Medicare and Medicaid, vaccination is mandatory with no testing option.
“We have been patient,” Biden said during the remarks. “But our patience is running out and your refusal has cost us all.”
He also added that the unvaccinated minority is causing “a lot of damage”.
Some Republican leaders have said the move will push private companies and workers to legally challenge the mandate, but health law experts have said the requirement is likely to stand in court.
“OSHA is a federal agency with the power to regulate businesses, and particularly large employers, to protect workers from disease,” said Pierre Jacobson, professor emeritus of health law and policy at the University of Michigan, in an interview with the Detroit Free Press. “It may require, for example, workers to wear certain safety glasses to protect themselves against injury and to take certain measures to prevent injury. It is therefore, historically, well within the purview of OSHA.
In a letter to employees – signed by Bin riney, the chief operating officer and president of health of the health group, and Dr. Adnan Munkarah, the hospital’s executive vice president and clinical director – hospital management has said they are committed to helping unvaccinated team members meet the requirement.
“Any team member who has not yet been vaccinated but demonstrates their commitment to being vaccinated by receiving their first dose today or by having a scheduled appointment with Employee Health can avoid suspension or resignation. voluntary, ”the letter reads. The health department gave unvaccinated workers who missed the Sept. 10 deadline to Oct. 1 to receive at least one dose of the vaccine to return to work.
