The Supreme Court upheld the prescription of the process of buying Senators against Silvio Berlusconi who demanded the acquittal of the bribery charge. The crime was reconverted into abusive bribery, as requested by the Pg, but the result of the prescription remained unchanged. According to the prosecution, Berlusconi had former Senator Idv Sergio De Gregorio 3 million euros to move from center to center right by voting the mistrust of the government in 2008.
With this verdict of the sixth criminal section, the supreme judges confirmed the order declared by the Court of Appeal of Naples on April 20, 2017, limiting itself to re-educate the crime. The constitution of a civil party of the Senate remains valid, which allows to obtain, by separate judgment, compensation for damages resulting from the purchase and sale of the parliamentary function. At first instance Berlusconi, with the former director of Avanti Valter Lavitola had been sentenced to 3 years with the suspension of public office for 5 years. Girolamo had negotiated a 20-month sentence in 2013.
Only the blue leader and Forza Italia appealed to the Supreme Court against the limitation period. Unsuccessfully Berlusconi's defense, with Professor Franco Coppi, baderted that "parliamentary activity is indisputable and can not be established if a vote is the result of giving money: the vote is covered by parliamentary immunity and can not be subject to investigation ".
