TAR rejects TIM's appeal. Effective December 31?

Another chapter in the now endless case of resolution on Free Modem. According to ANSA, the Latium ART has in fact given reason toAGCOM, opening the appeal presented by TIM few months ago.

The telephone operator, questioning theItalian Association of Internet Providers, had asked the judges to block the resolution because a possible entry into force could have generated major economic damage.

A thesis that was obviously not accepted by Regional Administrative Court, thanks to the work done by the lawyers ofAIIP who succeeded in breaking down the thesis presented by Italian society.

The decision, according to what has been collected, should enter into force on December 31, 2018except for other twists that could lead to another extension.

The order ofAGCOM provides that users can freely choose Internet access terminals from a fixed location ",while imposing specific obligations on operators to ensure that informed consumers have informed choices".

In a few days, however, still the Lazio TAR will be asked to discuss two other calls presented by Vodafone and Fastweb, which asks for the total cancellation of the resolution. If the judge accepted the request, the whole procedure could start from scratch, to the detriment of users who have been asking for implementation for some time.
