Queens of the Stone Age frontman Josh Homme still can’t contact his 15-year-old daughter, but he’ll be able to see his two youngest children on Tuesday night – on a video call, a judge ruled. The rocker, who has not seen the boys, aged 10 and 5, since August 26 amid allegations of domestic violence and a heated custody dispute, got the joint FaceTime call by the Los Angeles County Superior Court Judge Lawrence Riff. Subsequent 15-minute FaceTime calls with the boys will then continue every other day, the judge said in a hearing Tuesday morning.
“I don’t think I need to warn anyone, but I will: if I have any idea that someone is teaching these children not to talk to their father, it would be very hard for me.” Judge Riff said, clarifying that Dalle is not to monitor or record calls. “I think that would be a very bad thing.”
Man, 48, and his ex-wife Brody Dalle, 42, founder of punk band The Distillers, have been arguing over custody of their three children for months, with allegations of domestic violence, multiple police reports and claim that the other is an unfit parent. The dispute grabbed headlines earlier this month when the couple’s teenage daughter obtained a restraining order saying her father should stay 100 yards from her. The judge extended that restraining order until November on Tuesday with a follow-up hearing date set for October 29.
Meanwhile, Dalle is set to face contempt court on October 13, after refusing to hand over the children to Homme as required on September 3, a violation of a court order related to the 50-50 shared custody agreement of the couple. Dalle also filed restraining order applications against Homme on behalf of the two boys earlier this month, but the court urgently dismissed them pending a future hearing.
Lawyers for Homme and Dalle told the court on Tuesday that they hoped to arbitrate the dispute and possibly reach a settlement now that a court-appointed lawyer representing the children is involved. “I agree that pursuing all cases would be very helpful in this case,” children’s lawyer Sonia Dujan told the court. “[It] It would really be in the best interests of the children if we could reduce the conflict.
Queens of the Stone Age member Dean Fertita filed a statement on September 13, 2020 in the case supporting Male, saying he was present when one of the alleged incidents of domestic violence allegedly took place. He said the claim that Man was abusive in his presence “never happened”. “I never saw Josh doing anything inappropriate with the kids around me,” he wrote.
Male went to court in July and again this month with allegations that Dalle was babysitting the children for him in violation of their one-week custody agreement and one-week leave. For her part, Dalle claimed that she and the three children all tested positive for Covid-19 while on vacation in July and had to quarantine in a way that reduced Man’s on-call time. She then claimed that the children were not safe with their father.
