YOUNGSTOWN – A Mahoning County jury has ruled in favor of an Austintown woman who sued Boardman doctor Joseph F. Yurich and the Comprehensive Surgical Group of Northeast Ohio for medical malpractice. The jury awarded the woman $ 75,000 in damages.
The lawsuit brought by Leona Dixon from Austintown resulted in a jury trial before visiting Judge Thomas Pokorny at the Mahoning County Common Plea Court from August 30.
On September 2, the jury found that Yurich had made a decision that was not one that a reasonably prudent doctor would have made under the same or similar circumstances, according to court documents.
The jury found Yurich’s negligence to be the cause of the injuries she suffered. A call to his lawyer to find out what type of injuries were not returned.
Lawyers for Yurich and the medical office also did not respond to a call for comment.
The jury divided the damages into $ 5,000 for financial damages; $ 35,000 in non-economic damages, such as pain and suffering; and $ 35,000 for damages the woman may suffer in the future.
Yurich and the Comprehensive Surgical Group of Northeast Ohio have an office at 7645 Market St., Suite 200, in Boardman.
The complaint filed by Dixon on January 7, 2019, alleged that Yurich and the medical group provided him with medical treatment from January 30, 2017 to January 30, 2018.
She alleged that she suffered serious and permanent bodily injury, pain, mental anguish, emotional and psychological distress and expense as a result of the defendants’ negligence.
The defendants did not adequately inform Dixon of the risks and material benefits of the treatment and did not inform her of other forms of treatment, the lawsuit alleged.
The risks of care and treatment have indeed materialized, according to the alleged complaint.
In July 2017, Yurich was sentenced to 180 days in Mahoning County Jail – with all but 10 days suspended – after being convicted of driving homicide and failing to stop after an accident for hitting a boat at the Berlin reservoir in 2015, killing Neal Cuppett, 58, of Akron, who was on the other boat.
