The extraordinary SWAPO congress will proceed as planned after the Windhoek High Court has authorized the withdrawal of a case to arrest it on Tuesday afternoon.
Judge Thomas Masuku authorized the applicants Mirjam Shiitula and Selma Namboga to withdraw their urgent case and request the inclusion of all parties involved in the case.
Judge Masuku has postponed the remaining case, which is urgently challenging the Sixth Ordinary Congress held last year.
At the December hearing, Judge Masuku will determine whether the cost of Tuesday's case is to be paid before the remaining challenge is heard next year.
His decision follows concessions from lawyer Griffiths Madonsela, lawyer for Shiitula and Namboga, with a view to the adoption of the new orders.
Madonsela stated that the court's decision to notify all interested parties had left the plaintiffs with little information on how they should continue to make their claim.
He added that the applicants did not know why the court had pronounced in favor of the notification of all interested persons, which made the prosecution difficult for them.
