Nursing that has been routed to the emergency room is not reimbursable by the health insurer for day care. The criminal investigation began in 2014 as a result of the NZa investigation, which led to suspicions that VUMC's pediatric service was submitting incorrect statements.

The FIOD confiscated a hospital raid in 2016 explaining a number of patient records from 2010 and 2011 and sending mail about the statements. With this, the FIOD wanted to know if there were deliberately sent incorrect statements. Because the doctors and the hospital appealed to medical professional secrecy, the FIOD has not been able to include this information in the discovery of the truth. The Crown therefore decided to base the penalty only on the six offenses and on the deprivation of the undue advantage

The VU ™ acknowledged the illegal statements. According to the prosecution, no indication was found on the basis of available information that there was an active instruction within the organization to make incorrect statements. There were also no specific people in the picture who personally benefited from the overly high statements.
