Duterte explains why he did not appoint Deputy Chief Justice Carpio as Chief Justice

Metro Manila (CNN Philippines, November 29) – President Rodrigo Duterte did not appoint Judge Antonio Carpio – the highest magistrate of the Supreme Court – Chief Justice, while he had promised that his choice would be based on seniority.

On Wednesday, Duterte said that he thought Carpio was not interested in the position of Chief Justice, despite the formal acceptance of his appointment by the Deputy Chief Justice.

"Carpio, ingon siya niadto di siya mudawat.unya pagkahuman kay next in the rank, maoy akong nako next giingon in rank.Next to rank, kung maay," he said in a speech delivered in Lanao del Norte.

[Translation: Carpio, he said before he won’t accept the post. Then I’ve said the next in rank if you’re good.]

Duterte said that he had been given five names to choose from. He named third highest associate judge Lucas Bersamin as Chief Justice. But Malacañang pointed to the total number of years spent in justice instead of years spent in the high court.

Carpio declined his appointment as Chief Justice in July because he did not want to "take advantage" of the ousting of former Chief Magistrate Maria Lourdes Sereno.

Duterte also spoke of Carpio's role as a convinced critic of China-Philippines relations and his stance on the territorial conflict between China and China over the South China Sea.

Malacañang had previously stated that Carpio's views on the maritime dispute between the Philippines and China would not necessarily affect his candidacy for the post of Chief Magistrate.
