Metro Manila (CNN Philippines, November 27) – A new Chief Justice could be declared soon.
President Rodrigo Duterte made this revelation Tuesday night at a press briefing after the inauguration of Bohol-Panglao International Airport.
When asked if he had received the list of candidates for the position, Duterte replied: "Yes, I have already named one.I have signed the appointment before to leave … I've already chosen one. "
The president did not reveal who he had chosen, "The office will issue the appointment, then you will see that there is the name."
Duterte, however, revealed that seniority was one of the factors that he took into account in making his decision, without going beyond that.
The five Supreme Court justices who applied for the post of Chief Justice found themselves on the list of candidates submitted to President Rodrigo Duterte.
Deputy Judge Antonio Carpio, Deputy Judges Diosdado Peralta, Lucas Bersamin, Estela Perlas-Bernabe and Andres Reyes Jr. are candidates for the candidacy of Judge Teresita Leonardo-de Castro, who retired on 10 October after 40 days of holiday.
The secretary of justice, Menardo Guevarra, a member of the Judicial and Bar Council (JBC) in charge of screening the candidates for justice, confirmed this statement on 23 November.
After an in camera interview, the JBC voted in favor of Acting Chief Judge Antonio Carpio, Deputy Judges Diosdado Peralta, Lucas Bersamin, Estela Perlas-Bernabe and Andres Reyes Jr. All received six votes each from the JBC, with the exception of Junior Judge Reyes, who received five votes.
They needed the vote of at least four JBC members to be on the shortlist.
This is the second time that Duterte appoints a Chief Justice. He had previously chosen Judge Teresita Leonardo-de Castro despite his impending retirement. She left the vacant position again on October 10 after a 40-day stay.
De Castro replaced Maria Lourdes Sereno, who was ousted by the Supreme Court for failing to file her full statements of assets, liabilities and net worth.
Carpio, who has repeatedly criticized the moderate position of the administration on the dispute in the South China Sea, now heads the High Court, which is the highest acting magistrate. Earlier, Duterte had declared that she had chosen De Castro because she was the oldest of the three judges on the short list. When asked on October 9 last when he would name Carpio for the same reason, Duterte only said, "I will decide when I will cross the bridge."
