Police in California identified the woman and child who died during a San Diego Padres game over the weekend, and a lawyer representing the family says a trial is underway.

Raquel Wilkins, 40, fell to death on the railing of a dining room on the third level of the baseball stadium on Saturday, FOX 5 San Diego reported, citing local law enforcement. She was holding her son, Denzel Browning-Wilkins, 2, who also died in the fall.

Daniel Gilleon, a lawyer representing the family, said FOX 5 San Diego the family intends to file a wrongful death complaint. He did not offer a timeline or indicate who the prosecution would name as defendants.

“When you take money from people and make a lot of money, they shouldn’t fall six stories to death from a bench right next to a fence,” the lawyer said. “All kinds of ways to protect yourself from this.”

San Diego Police said an investigation was underway into the deaths, noting the deaths “looked suspicious.” San Diego Mayor Todd Gloria also told the station on Monday that there were “unusual circumstances surrounding the case that we are continuing to investigate.”

Witnesses came forward saying they saw Wilkins jump onto table benches closest to the railing while holding his child and appeared to lose his balance before finally falling.
