<p> On March 15, 2018, came into force three major texts that reinforce and modernize the OHADA system of alternative dispute resolution: </p>
<ul class=

  • A new Uniform Act Relating to the Law of Arbitration which replaces the Uniform Act of 11 March 1999 and enhances the transparency, speed and efficiency of arbitral proceedings in the OHADA area;
  • A Regulation Revised Arbitration of the Joint Court of Justice and Arbitration (CCJA), which aims at strengthening the independence and competitiveness of the CCJA Arbitration Center through a better harmonization of the Rules with the Uniform Act on the Right to arbitration and international best practice;
  • A tenth Uniform Act, relating to mediation, to fill the existing legislative vacuum in most OHADA Member States and to promote this process amicable settlement of disputes
  • These new texts are likely to strengthen investor confidence and significantly improve the business climate in the OHADA space. They are presented in the form of the Acts and Regulations as published and commented article by article by three eminent experts of the OHADA law:

    • Jean-Marie TCHAKOUA Associate of the Faculties of Law, is a full professor University of Yaounde II. Professor Tchakoua has a wealth of teaching and research experience, including on alternative dispute resolution. He is arbitrator at the Arbitration Center of the CCJA and at GICAM
    • Narcisse AKA was a magistrate, then a lawyer. He was Secretary General of the Court of Arbitration of Côte d'Ivoire (CACI) from 1996 to 2004. Since February 2014, he is the Secretary General of the CCJA-OHADA and trainer in public and private universities;
    • Master Alain FÉNÉON is a lawyer (H) at the Paris Bar. Editor of the first draft of the Uniform Act on Arbitration, then several other texts on arbitration and mediation, he taught OHADA law, notably at Sciences Po Paris. He is an arbitrator with the CCI and the CCJA, specializes in investment arbitration and acts as international mediator and expert in OHADA law.

    This work prefaced by Pr Dorothé COSSI SOSSA Permanent Secretary of the OHADA, is clearly indispensable to all OHADA arbitration and mediation practitioners: magistrates, lawyers, corporate lawyers, legal professionals, teachers and students.
