The owner of a collection company has obtained models of legal letters on the Internet and has amended them for commercial purposes from 2013 to 2015, said a court.
On Monday, November 26, in the state courts, Tan Kian Tiong, 52, pleaded guilty to 60 charges, 40 under the Legal Profession Act and 20 under the law on limited liability companies.
A further 756 counts under the old law and 327 under the other law will be taken into account when Tan is convicted at a later date.
The court heard that Tan was the sole owner of Double Ace Associates, which provides debt collection services.
The company would hire customers who wanted their debtors to repay their debts. It would charge a commission of 30% for the recovery of debts. Some guests would be charged a service fee to cover transportation and other expenses.
As part of his business, Tan would send letters of request to alleged debtors of clients. He obtained the template for these legal letters on the Internet and made changes to it. He also mentioned copies of letters of request sent by various law firms.
In the request letters sent by the firm, according to Tan's instructions to his staff, the template indicated that Double Ace Associates "acted for" a client and that the firm was "informed" that there was a sum of money. "Due" and "owner" of the alleged debtor to the client.The recipients were asked to make their payments within seven days to "prevent our client from pursuing a lawsuit".
The letterheads included the words "legal counsel" immediately after the words "Double Ace Associates LLP". However, Double Ace Associates was neither a law firm nor a limited liability company.
