A 28-year-old nightclub waiter who drank at work and had an argument with a group of clients gathered members of his secret society to confront him, a court said.
The confrontation last March resulted in one member of the secret society stabbing a client at the front and back of his head, at the sight of a crowd of people, and caused his death.
On Monday, November 26, in the state court, server Shawalludin Sa'adon was sentenced to five and a half years in prison with six canes for his role in the assault.
He pled guilty to a charge of causing serious injury.
Argumentation on a bottle of alcohol
The court heard that on March 12 last year, around 4:30 am, Shawalludin noticed a bottle of alcohol on the Postbar floor at St James Power.
He told his clients Satheesh Kumar Manogaran, 34, Naveen Lal Pillar, 29, Suniljit Singh, 34, Parveen Kayr Shimbhir Singh, 23, and Aishini Velu, 16, who should not be left behind. bottle on the floor.
An argument broke out between Shawalludin, Satheesh and Naveen. Suniljit and two of Shawalludin's colleagues then separated the men. Shawalludin's supervisors also asked him to leave the station to cool things down.
On the outside, Shawalludin called Muhammad Hisham Hassan, 28, and asked him to gather members of their 369 subgroup of the secret society group Sio Kun Tong to confront Satheesh and Naveen.
Hisham, Muhammad Khalid Kamarudin, 22, and Muhammad Faizal Mad Jamal, 23, met Shawalludin at the entrance to the Postbar around 5.30 am
Shawalludin has reported Satheesh and Naveen to his gang members. Customers were returning home and waiting for a private rental car.
However, as there were uniformed policemen in the area, Hisham told Khalid and Faizal to be patient and wait for the opportunity to attack. Hisham then is separated from the group to make calls.
The victim was repeatedly stabbed
Shortly after, a distinct disorder caught the attention of the police. At the same time, Satheesh, Naveen and their friends started walking towards a private rental car.
Shawalludin and his gang members followed the club's bosses. Shawalludin called "Bro, bro" to the group and started arguing with Satheesh.
Khalid then hit Satheesh before repeatedly stabbing him with a folding knife – once on the forehead, twice in the back of the head and twice on the back. Shawalludin and Faizal hit Satheesh several times.
Even after Satheesh fell to the ground, Khalid, Faizal and Shawalludin continued to hit him. Khalid, Faizal and Shawalludin then attacked Naveen.
As it was the closing time of most pubs in the area, a large crowd attended the Satheesh and Naveen assaults.
The accused continued his work
After the attack, Shawalludin washed the blood of the hands in a toilet at Postbar before continuing his work. Khalid and Faizal fled in a taxi and alerted Hisham of the fight. Hisham then left in a separate taxi.
Shortly after, Shawalludin learned from his colleagues that Satheesh was dead. The waiter recovered his salary for the day, then took his breakfast and went home. The officers stopped him there.
A medical examiner has certified that Satheesh's cause of death was due to a stab wound. Injuries have spread to the brain and the aorta – the largest artery in the body. The left lung of the victim completely collapsed and the right lung was deflated.
Mato Kotwani, Shawalludin's attorney, told the court that his client was not aware that Khalid had brought a knife until the latter began stabbing Satheesh.
Hisham was sentenced to 18 months in jail for accommodating Khalid in his godmother's apartment after the incident. Khalid and Faizal have yet to be treated.
For causing serious injury, Shawalludin could have been sentenced to 10 years in prison, a fine and caning.
