A Republican congressman from Pennsylvania on Tuesday asked the Supreme Court to issue an emergency order that would prevent his state from taking further steps to certify its election results showing a victory for President-elect Joe Biden over President Donald Trump.
Representative Mike Kelly’s request comes after Pennsylvania Gov. Tom Wolf certified that the former Democratic vice president won the state and his 20 constituency votes.
In light of this, Kelly asked the Supreme Court to “overturn” Wolf’s certification and all other actions that would legally confirm Biden’s victory. His filing on Tuesday also asked the Supreme Court to hear an appeal of his challenge to a change to the postal voting rules in the state.
The request relates to an earlier case in state courts, where Kelly claimed the Pennsylvania legislature violated the state constitution by allowing absentee voting without excuse in light of the coronavirus pandemic .
The Pennsylvania Supreme Court dismissed this request earlier this week.
Biden is currently expected to win 306 Electoral College votes, 36 more than he needs to clinch a victory in the White House race.
Trump refused to concede to Biden, falsely claiming he won the election and that there had been widespread voter fraud.
Earlier on Tuesday, U.S. Attorney General William Barr said the Justice Department had found no evidence of large-scale fraud that would have nullified Biden’s intended victory.
The Trump campaign and his allies have repeatedly lost or withdrawn lawsuits aimed at invalidating ballots for Biden in several battlefield states.
