(CNN) – A 13-year-old student is in custody following a shooting at Cummings K-8 Elementary School in Memphis, Tennessee on Thursday morning, Memphis Police Department deputy chief Don Crowe said , in an update Thursday evening
The victim of the incident, also 13, continues to recover at Le Bonheur Children’s Hospital under the care of the hospital’s pediatric trauma team, said Chief Medical Officer Dr Barry Gilmore happiness.
Detectives investigating the case have consulted with the district attorney general’s office and the suspect should be charged with attempted first degree murder, Crowe said.
According to the deputy chief, he will be brought before the juvenile court.
“Now we also have to think about: how did a 13 year old teenager get his hands on a gun? Law? This is a question we all want answered. I’m not sure we’ll ever find the whole truth, but certainly this begs everyone to keep their guns safe, so 13-year-olds can’t get their hands on those guns, ”Crowe said.
“So far this year, we have treated over 100 gunshot wounded children in this community,” Gilmore noted. “With that we are on the verge of breaking last year’s record, which was 135.”
