Anyone who intends to appeal against a judgment must make sure to submit it to the post at least three business days before the deadline for appeal. The Supreme Court stated in a judgment that Postnord's new requirement that letters are normally sent to the addressee within two working days of the filing date is taken into account.

If the letter with the appeal is filed later and so it arrives late, what the so-called law is not deemed valid, that is, that you have a valid excuse for this delay.

The case HD testing is about a man involved in a case that was due to be appealed by January 23 of last year. He left the letter for delivery of mail on January 21, but the appeal was filed in the District Court only on the 24th. Thus, the District Court found that the appeal was too much late and HD therefore felt that the man could not be considered to have reached legal maturity.

In the past, HD has stated that "in the case of a promotion by mail, there are usually reasons to expect a delay compared to the requirements imposed on the person who promotes the post".
