200 francs of bus, 320 francs of fees and expenses: 520 francs at the expense of a young farmer from the canton of Lucerne. He recently received a criminal order from prosecutor Sursee for embarrassing other road users in Oberkirch, writes the "Bauernzeitung".
In particular, the 18-year-old farmer had just delivered a cargo of fruit in mid-October in Oberkirch (LU). When he returned, he drove his tractor on the road, causing a column. According to the report, at least ten cars would not have been able to overtake themselves because of the tractor.
Between 25 and 30 km / h
Simon Kopp, Public Prosecutor's Information Officer, confirms the facts. According to the criminal order, the farmer has traveled the stretch of Landi Oberkirch to Nottwil on the cantonal road at a speed of between 25 and 30 kilometers at the hour. He had a distance of 3.5 km, the vehicles behind him not exceeding, relieved or possible.
According to Kopp, he did not use "various vanishing points". Police reported to the farmer: "A patrol saw him miss several opportunities to get out of the way." The penalty order is now final.
Eight and a half instead of about five minutes
The cars had to drive about eight and a half minutes outside the city, behind the tractor with trailer. According to Google Maps, it takes five minutes to the normal speed of the Landi Oberkirch in the center of Nottwil. See the timelapse video above where the farmer drove.
Farmers must allow overtaking
According to the Bauernzeitung, Franz Zemp, head of the transport department of the police in Lucerne, reportedly said: "Motorists must facilitate overtaking faster motorized vehicles by driving to the far right and keeping them on clear ground . "
Farmer says that he could not go beyond
The farmer touched * sees things very differently. He confirms that he traveled this route at about 25 km / h. Dodge was not possible for him: "In the first place, I could have avoided it if I had driven only with the tractor. But I had a trailer with me. At another possible time, an exit, there was a car on the way. And in front of a traffic light where there is a bus stop, "I would have crossed a safety line to allow the rear vehicles to overtake."
The following alternative site was privately owned. "These are not considered as peripheral areas, but as areas of the city. The rear vehicles must give way to trucks outside the city," says the farmer.
He did not want to damage the meadows of his professional colleagues
He could have avoided the Wiesland on the track. But the young farmer did not want that: "That day the meadows were wet, I would have destroyed the meadows with my heavy tractor, and my colleagues would certainly have appreciated it."
He also explained all this to the police. "I had to scratch my head while I was still stung." His conclusion: "I see this as a brute, I find it too much to ask an 18-year-old man with more than 520 francs to pay for such an offense, I do not think it's proportionate."
"The warning would have been enough"
According to the newspaper, the legal counsel of the Lucerne Farmers' Association badly understands the punishment. Raphael Kottmann judges the punitive order for the young farmer rather disproportionate. In view of the facts described, only one warning could have been given.
After all, the young farmer consoles himself: "I did not make any objections based on the recommendation of my legal protection insurance, it takes care of the damage for me."
On this road, traffic was blocked because of the tractor. See also in the video above where he went.
