The parents of a daughter of Therwil BL were transferred to federal court to build a tree house for their daughter. However, the Lausanne judges have now confirmed the cantonal authorities' opinion that a building permit for the tree house is necessary.

The parents had created a platform of about 2.5 meters by 3 meters on a tree when they were forbidden under pain of undergoing work. You must either submit a construction application or cancel the case.

The tree is in reserve

Since the tree is in a reserve area, the regulations apply to the non-construction area. Thus, the provisions relating to construction in the agricultural zone and the exceptions for buildings located outside the construction zones, provided for in the Planning Act, come into play.

The Federal Court has denied the existence of a reference to the agricultural use of a treehouse, since the house of a "leisure activity" is used.
