Federal Councilor Simonetta Sommaruga acknowledged to the Council of States that the cities of origin of the refugees had caused much discontent. Therefore, the Federal Council also proposed to reverse the burden of proof at the expense of refugees. This will also be borne by the Federal Administrative Court. The national council's solution goes too far and goes against the Geneva Refugee Convention.
The Council of States now wants to relax the total ban: the refugee must make his obligation to travel credible because of a "constraint" in his country of origin. The version of the Council of States is a compromise and would strengthen the existing law.
